1. @Home Provisioning More; AT&T Bid Opposition Grows
@Home has resumed new subscriber provisioning for 18 of 20 of its affiliates, based on new agreements that call for the affiliates to pay debt they owe to @Home and an increase in monthly per subscriber fees from $12 to $15 per sub to around $20 per sub. Affiliate debt is estimated to be $47 million. Nearly all affiliates have accepted the new arrangement as a temporary solution, while building a system in-house to conduct provisioning free of @Home's operations.

In other news, opposition to AT&T's bid to buyout @Home for $307 million has escalated in the past week. A group of 250 shareholders has hired San Francisco attorney, David Replogle, to argue that the company should continue as an independent business, under the theory that the company is worth $3 billion and could be profitable after a reorganization. A bondholder group, consisting of creditors owed $747 million, has already filed its own opposition in bankruptcy court.

In the meantime, AT&T has voluntarily removed four of its people from the @Home board including Frank Ianna, Charles Noski, Daniel Somers, and AT&T Chairman, C. Michael Armstrong. The departure is recorded as being retroactive to October 1, 2001. AT&T has relinquished its right to replace these members. Two AT&T representatives still remain on the board including Mufit Cinali and John Petrillo.

@Home stock is now being traded over the counter, after being removed from the Nasdaq on October 1, after falling to 14 cents per share.

2. EarthLink & AOL Launch in Even More TW Markets
EarthLink and AOL have announced the launch of their respective access services over Time Warner's cable systems in Rochester (474,000 HHP), Northeast Ohio including Cleveland, Akron, and Canton (386,000 HHP), Charlotte (580,000 HHP), and Central Florida (685,000 HHP) including Melbourne, Daytona Beach, Orlando, Palm Bay, and Titusville.

EarthLink has said that it expects to offer services to half of Time Warner's homes passed by the end of the year. The ISP also announced that it would encourage prospective broadband consumers to choose cable over its DSL service, a decision that Chief Garry Betty, EarthLink's chief executive, stated was based on "its economic benefit to us."

3. AT&T Broadband Appoints New Management Team
AT&T has announced that it has replaced AT&T's Broadband president and chief executive Daniel Somers with William T. Schleyer, former head of MediaOne Group. David Fellows has been appointed as the CTO and Ron Cooper will become the new COO. All are former MediaOne and Continental Cablevision executives.

4. Dorado Introduces Sub Mgmt & Provisioning Solution
Dorado Software has introduced Redcell Access Cable 3.0, a subscriber management and provisioning solution for data and voice over cable services.

The subscriber management toll features subscriber definition, registration and management, with external APIs for billing and CRM integration. The solution includes a co-branded self-care customer web site.

Dorado's service provisioning and activation solution features automated activation of broadband services for DOCSIS/EuroDOCSIS cable modems, PacketCable-based MTAs and support for Terayon's proprietary system. The software provides automated assignment of IP addresses, both static and dynamic, to MAC address to subscriber data with embedded DHCP, TFTP, and TOD servers. It supports service activation for multiple ISPs over the network. The system also provides usage data collection with associated correlation and binding of subscriber-MAC address-IP address with support for peering of this data with multiple ISPs and MSO billing and billing mediation systems.

The bandwidth management element provides real-time management and re- provisioning of the cable network. It enables operators to monitor, predict and re-provision bandwidth utilization on a per-service, per-subscriber basis. Real-time analysis of bandwidth utlization at the CMTS and cable modem level are also provided.

5. Terayon Introduces Imedia Semiconductor Business
Terayon has introduced a new independent semiconductor business to be known as Imedia Semiconductor. The Santa Clara based company will design, manufacture and sell silicon for cable equipment manufacturers.

The company's initial product offering will include its IM6000 chip and IM96000 reference design for cable modems. The chip is the DOCSIS 1.0 certified technology that Terayon has been using with its TJ615 cable modem. It is 1.1 based and will likely accommodate 2.0 quickly, considering Terayon's S-CDMA is key component in the 2.0 spec, which supports an advanced PHY. Pricing is set at $25 per chip in volume.

Terayon has shipped more than 2.1 million cable modems and 6,000 headends.

6. Brooks Bay & Sunshine Deploying Terayon in B.C.
Brooks Bay Cable of Port Alice, B.C. and Sunshine Communications of Grand Forks, B.C. will be deploying Terayon's BE 2000 cable modem system.

7. Com21 Appoints New President & CEO
Com21 has announced the appointment of George Merrick as the new company president and CEO, effective immediately. Merrick replaces Craig Soderquist, who resigned last Monday. Merrick is the former CEO of Advanced Rendering Technology, a company based in Cambridge, England.

8. Best Buy to Resell EarthLink & Road Runner Services
Best Buy has said that it will offer broadband services from MSN, EarthLink, and Road Runner. In-store kiosks will provide service availability information as well as provide demonstrations of the technology and service sign-up. Last week, Best Buy announced that it would carry Comcast's @Home service. AT&T's @Home is also offered through the retailer, with 135 stores reselling the service.

9. Cox Deploying Motorola's CMTS/Routers in Las Vegas
Motorola has announced that Cox Communications is deploying its DOCSIS BSR 64000S router for data services in Las Vegas. Motorola's CMTS/router gear has been approved by the MSO as a viable solution for its systems nationwide.

10. Correlant Using Ashley Laurent with Modem Chip
Ashley Laurent has said that Correlant will use its Broadway Integrated Services Software as part of its cable modem and set-top box products. The software will provide optional support for a managed firewall, content filtering, managed VPNs, and other capabilities.

11. Adelphia Deploying Valley's Cable Modem Router
Valley Technologies has announced that Adelphia is deploying its ZyXEL p944 cable modem/router with an integrated multi-port hub. The modem provides management of the number of computers that users connect to a single cable modem.

Valley has said that its WLAN and VoIP cable modems will become available before the end of the year.

12. Cogeco Ends August with 107,938 Data Subs
Cogeco has reported ending August, its fiscal year, with 107,938 cable modem subscribers, serving 88,038 in Ontario and 19,900 in Quebec.

13. Comcast Ends Q'3 with 792,700 Data Subs
Comcast has reported ending the third quarter with 792,700 @Home subs, adding 117,100 or 9,000 weekly for the quarter. The service passes 70% or 9,624,300 homes, giving the MSO a penetration rate of 8.2%.
